Terms of Service

1. Acceptance and eligibility

By creating an account or using the Itty Bitty Mosquito Portal, you agree to these Terms. You must be at least 18 years old and able to form a binding agreement.

2. The service and volunteer roles

The Itty Bitty Mosquito Portal helps neighborhoods coordinate mosquito control, organized into roles (neighbors, volunteer Block Captains, neighborhood administrators, and platform administrators), each with different abilities. Block Captain and neighborhood administrators are volunteer roles; they create no employment or agency relationship with us.

3. Volunteer roles disclaimer

Volunteer Block Captains and coordinators are community volunteers. They are not agents, employees, pest-control professionals, public-health officials, or representatives authorized to provide professional advice on behalf of Itty Bitty.

Help they provide is offered in a neighborly, volunteer capacity and is not professional pest-control or public-health advice.

4. Your responsibilities (acceptable use)

You agree to:

• Provide an accurate address and information, and keep it current
• Use others' contact info only to coordinate mosquito control, never for marketing or other profit, harassment, or unrelated purposes
• Make standing-water and catch-basin reports accurately and in good faith, since a report can prompt a government inspection of a property
• Not publicly post participant information, screenshots, maps, or photos that identify another participant without permission
• Not harass, threaten, or harm other users
• Not attempt to deidentify or otherwise manipulate data
• Not scrape or harvest data, or access information you are not entitled to
• Not upload unlawful content, or photos that violate others' privacy or rights

We may suspend or remove accounts that violate these Terms.

5. Intellectual property and ownership

The Portal, including all software, designs, and content, is the intellectual property of Michelle Mingrone and Howard Schindel (collectively, “the Developers”). All rights reserved. We grant you a limited, personal, non-transferable right to use the service for its intended purpose.

Itty Bitty operates the Portal under a license from the Developers. The Developers may transfer ownership or operation of the Portal to another entity in the future. If they do, users will be notified of any material change to ownership or these Terms, and continued use of the Portal after such a change constitutes acceptance of the updated Terms.

You keep ownership of the notes, photos, and other content you add. By adding them, you grant a non-exclusive license to store, display, and use that content to operate and improve the service.

Information collected from participants (including the trap and block data) is held by the operator (Itty Bitty Mosquito Committee) and governed by the Privacy Policy. It is not part of the Portal intellectual property owned by the Developers, and it is not transferred in connection with any change in Portal ownership except as the Privacy Policy allows (see the Privacy Policy section on business transfers). The operator may use aggregated and de-identified data for research and efficacy evaluation as described in the Privacy Policy.

6. No warranty; mosquito-control disclaimer

The service is provided “as is.” It is an informational and coordination tool. It does not guarantee mosquito reduction, pest elimination, or any health outcome, and is not a substitute for professional pest control or public-health guidance. Maps, reminders, and weather data may be incomplete or inaccurate.

7. Limitation of liability

To the maximum extent permitted by law, Itty Bitty and the Developers are not liable for indirect, incidental, special, or consequential damages arising from your use of the service. In no event shall the aggregate liability of Itty Bitty and the Developers exceed the greater of $100 or the total fees you have paid to use the service.

8. Indemnification

You agree to indemnify and hold harmless Itty Bitty and the Developers and Itty Bitty’s directors, officers, volunteers, employees, and agents from claims arising from your misuse of the service.

9. Termination

You may stop using the service and delete your account at any time. We may suspend or end access if you violate these Terms or to protect the service or its users.

10. Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control.

11. Severability

Unenforceability of any provision contained in these Terms shall not affect or impair the validity of any other provision of these Terms.

12. Changes to these Terms

We may update these Terms; continued use after an update means you accept the revised Terms. We will update the effective date and, for material changes, notify you in the app.

13. Governing law and venue

These Terms are governed by the laws of the District of Columbia, without regard to conflict-of-law principles. Exclusive venue for any dispute arising from these Terms shall be the state or federal courts located in the District of Columbia, except where prohibited by applicable law.
